1. Plain-language summary

We collect only what we need to respond to you and deliver our services. We don't sell your data. We use a small number of trusted third-party tools (Formspree for forms, Google Analytics for site traffic, Google Fonts for typography, and WhatsApp/Meta when you message us). You can ask us to show you, correct, or delete your data at any time by emailing hello@ace.co.ke.

The rest of this page explains the details. If anything is unclear, contact us and we'll explain it in plain terms.

2. Who we are

Ace ("we", "us", "our") is an AI visibility agency based in Nairobi, Kenya, operating the website at ace.co.ke. For the purposes of the Kenya Data Protection Act 2019, we are the data controller for personal data collected through this website and in the course of providing our services.

Contact: hello@ace.co.ke or WhatsApp +254 731 058 323.

3. What we collect

We collect the following categories of personal data:

Category What it includes How we get it
Contact details Your name, business name, industry, website, email address, and phone number. You provide these when you submit the contact form or the AI Visibility Check modal.
Message content Any information you choose to share in the message field or by email or WhatsApp. You provide this directly.
Client engagement data Business information, brand assets, and communications shared during a paid engagement. You provide this as part of the service.
Analytics data Anonymised information about how visitors use our site, such as pages viewed, time on page, approximate location (country/city level), device type, and referring source. Collected automatically by Google Analytics when you visit the site.
Technical data IP address and browser information, captured incidentally by our hosting provider and Google Analytics. Collected automatically.

We do not collect payment card details on this website. If you pay us, payment is handled through the method we agree (bank transfer or mobile money) and we only retain the transaction confirmation, not your full payment credentials.

We do not knowingly collect sensitive personal data (such as health, biometric, or political information) and ask that you do not send it to us.

4. How we use it

We use your personal data to:

  • Respond to your enquiry and schedule your AI Visibility Check.
  • Deliver the services you've engaged us for, including research, reporting, and follow-up.
  • Send you the deliverables and any related correspondence.
  • Issue invoices and manage payment.
  • Understand how our website is used so we can improve it.
  • Comply with legal and accounting obligations.
  • Protect against fraud, misuse, or unlawful activity.

We do not use your data for automated decision-making or profiling that produces legal effects. We do not sell your data, and we do not share it with advertisers.

5. Our legal basis

Under the Kenya Data Protection Act 2019, we rely on the following lawful bases:

  • Consent: when you submit a form or message us, you consent to us using your details to respond and provide the requested service. You can withdraw consent at any time.
  • Contract: when you engage us for a paid service, we process your data to perform that contract.
  • Legitimate interests: for site analytics, security, and improving our services, balanced against your rights.
  • Legal obligation: where we are required to retain records for tax, accounting, or legal purposes.

6. Who we share it with

We share personal data only with the following categories of service providers, and only to the extent needed:

  • Formspree (form submission processing). When you submit the contact form or the AI Visibility Check modal, your entries are transmitted to and stored by Formspree so we can receive them. See Formspree's privacy policy.
  • Google (Analytics and Fonts). Google Analytics collects anonymised usage data. Google Fonts serves typefaces used on this site. See Google's privacy policy.
  • Meta / WhatsApp. If you contact us via WhatsApp, your message is processed by Meta under its own terms. See WhatsApp's privacy policy.
  • Hosting provider. Our website is hosted with a third-party provider that stores server logs and site files.
  • Professional advisers. Accountants, lawyers, or auditors, where necessary and bound by confidentiality.
  • Legal authorities. Where we are legally required to disclose.

We do not sell or rent your personal data to anyone.

7. Cookies and analytics

Our site uses a small number of cookies and similar technologies:

  • Google Analytics cookies (_ga, _gid). These help us understand aggregate site usage. The data is anonymised and does not identify you personally.
  • Functional storage. We may use browser storage to remember simple UI state (such as whether you closed the modal). This is not used for tracking.

We do not currently run advertising cookies or third-party tracking pixels beyond Google Analytics.

You can block or delete cookies through your browser settings. If you block Google Analytics cookies, the site will still work. You can also install the Google Analytics opt-out browser add-on.

8. How long we keep it

  • Enquiries that don't become clients: up to 12 months, then deleted.
  • Client engagement records: for the duration of the engagement plus 7 years, to meet Kenyan tax and accounting requirements.
  • Analytics data: retained by Google Analytics for 14 months (our configured setting), then automatically deleted.
  • WhatsApp and email correspondence: retained as long as needed for the relationship, then archived or deleted.

If you ask us to delete your data and we have no legal obligation to retain it, we will do so within 30 days.

9. How we protect it

We use reasonable technical and organisational measures to protect your data, including:

  • Encrypted transmission (HTTPS) across the site and form submissions.
  • Access controls so that only team members who need your data can see it.
  • Reputable third-party processors who maintain their own security standards.

No system is perfectly secure. If we become aware of a data breach affecting your personal data, we will notify you and the Office of the Data Protection Commissioner as required by law.

10. Your rights

Under the Kenya Data Protection Act 2019, you have the right to:

  • Be informed about how we use your data.
  • Access the personal data we hold about you.
  • Request correction of inaccurate data.
  • Request deletion of your data (where we have no overriding legal obligation to keep it).
  • Object to or restrict certain processing.
  • Withdraw consent at any time, where consent is our basis.
  • Request portability of data you provided to us.
  • Lodge a complaint with the Office of the Data Protection Commissioner.

To exercise any of these rights, email hello@ace.co.ke. We will respond within 30 days. We may ask you to verify your identity before acting on a request.

11. Children

Our services are intended for businesses and adults. We do not knowingly collect personal data from anyone under 18. If you believe a minor has provided us with data, contact us and we will delete it.

12. International transfers

Some of our service providers (Google, Formspree, Meta) store data on servers outside Kenya, including in the United States and the European Union. When we transfer data internationally, we rely on the providers' own safeguards, such as standard contractual clauses and adequacy decisions, to ensure your data receives an appropriate level of protection.

13. Changes to this policy

We may update this policy from time to time. The "Last updated" date at the top reflects the most recent revision. Material changes will be highlighted on this page. Continued use of our website after changes are posted constitutes acceptance of the updated policy.
